Terms of Service

PILOTPILOT TERMS OF SERVICE

Effective Date: August 13, 2026

IMPORTANT: PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A BINDING ARBITRATION AGREEMENT, CLASS ACTION WAIVER, JURY TRIAL WAIVER, LIMITATIONS OF LIABILITY, AND OTHER PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS.

These Terms of Service ("Terms") constitute a legally binding agreement between you and PilotPilot ("PilotPilot," "we," "us," or "our"), governing your access to and use of:

  • pilotpilot.net;
  • the PilotPilot web application;
  • the PilotPilot Connector;
  • PilotPilot APIs;
  • desktop software;
  • career simulation systems;
  • flight tracking and telemetry services;
  • subscriptions;
  • lifetime-access products;
  • community features;
  • artificial-intelligence features;
  • and any other software, websites, products, content, or services that link to these Terms,

collectively, the "Services."

By creating an account, purchasing access, downloading or installing the PilotPilot Connector, clicking a button indicating acceptance, or otherwise accessing or using the Services, you agree to these Terms.

If you do not agree, do not use the Services.

1. ELIGIBILITY

You must be at least 13 years old to use PilotPilot.

If you are under the age of majority where you live, you may use PilotPilot only with the permission and supervision of a parent or legal guardian.

If you are a parent or legal guardian who permits a minor to use PilotPilot, you agree to these Terms on the minor's behalf and are responsible for the minor's use of the Services.

You may not use PilotPilot if:

  • applicable law prohibits you from doing so;
  • your account was previously permanently terminated by PilotPilot and we have not authorized you to create another account;
  • you are accessing PilotPilot for unlawful purposes; or
  • your use would violate applicable sanctions, export-control laws, or other legal restrictions.

2. WHAT PILOTPILOT IS

PilotPilot is an entertainment and simulation platform designed primarily for use with flight simulation software.

PilotPilot may simulate aspects of professional aviation, including:

  • corporate aviation;
  • private aviation;
  • Part 91-style operations;
  • Part 135-style charter operations;
  • fractional aviation;
  • aircraft management;
  • contract pilot work;
  • employment;
  • compensation;
  • flight scheduling;
  • dispatch;
  • crew duty;
  • passenger operations;
  • aircraft maintenance;
  • aircraft assignments;
  • pilot qualifications;
  • flight departments;
  • type ratings;
  • career advancement;
  • and other aviation-related concepts.

These systems are fictional, simulated, simplified, or adapted for entertainment purposes.

PilotPilot is not an actual air carrier, charter broker, aircraft operator, aviation employer, flight school, aviation training provider, dispatcher, flight-planning authority, maintenance provider, or governmental aviation authority.

3. NOT FOR REAL-WORLD AVIATION USE

PILOTPILOT IS FOR FLIGHT SIMULATION AND ENTERTAINMENT PURPOSES ONLY.

You must not use or rely upon PilotPilot for actual aircraft operations.

PilotPilot is not approved or intended for:

  • real-world flight planning;
  • navigation;
  • dispatch;
  • weather decision-making;
  • fuel planning;
  • aircraft performance calculations;
  • weight and balance;
  • flight following;
  • crew duty or rest compliance;
  • airworthiness determinations;
  • maintenance decisions;
  • emergency procedures;
  • regulatory compliance;
  • pilot certification;
  • flight training credit;
  • logbook certification;
  • aeronautical decision-making; or
  • any other safety-critical aviation purpose.

Information presented by PilotPilot may be simulated, delayed, incomplete, fictional, inaccurate, generated automatically, or based on data from third-party simulation software.

Any simulated:

  • pilot certificate;
  • rating;
  • qualification;
  • type rating;
  • flight time;
  • employment history;
  • salary;
  • operator authorization;
  • training record; or
  • other credential

exists exclusively within PilotPilot and has no real-world legal or regulatory effect.

Never represent a PilotPilot qualification as an actual pilot qualification.

4. MICROSOFT FLIGHT SIMULATOR AND THIRD-PARTY PRODUCTS

PilotPilot is an independent third-party product.

PilotPilot is not Microsoft, Xbox, Asobo Studio, or any aircraft manufacturer, simulator publisher, aircraft developer, avionics manufacturer, airport operator, FBO, charter operator, or other third party referenced through the Services.

Microsoft Flight Simulator, Microsoft, Xbox, and related names and marks are the property of their respective owners.

Use of a third-party name, aircraft designation, airport, product, service, trademark, or other identifier does not imply sponsorship, approval, affiliation, certification, or endorsement unless expressly stated.

PilotPilot is not endorsed, sponsored, certified, or supported by Microsoft solely because PilotPilot interfaces with Microsoft Flight Simulator.

PilotPilot may rely upon interfaces such as SimConnect and other functionality exposed by flight simulation software.

Third parties may modify, restrict, discontinue, or break those interfaces without our control.

5. THIRD-PARTY AIRCRAFT, MODS, AND ADD-ONS

PilotPilot may interact with:

  • default simulator aircraft;
  • third-party aircraft;
  • freeware;
  • payware;
  • modifications;
  • avionics;
  • scenery;
  • utilities;
  • weather engines;
  • navigation products;
  • or other simulator add-ons.

Compatibility is not guaranteed.

Different aircraft may expose different simulator variables or telemetry.

As a result:

  • some metrics may be unavailable;
  • some metrics may be approximate;
  • some systems may be unsupported;
  • third-party updates may temporarily or permanently break compatibility;
  • and some aircraft may require specific PilotPilot compatibility profiles.

PilotPilot is not responsible for third-party software, third-party purchases, or modifications made by third-party developers.

Your use of third-party products remains subject to the terms imposed by those third parties.

6. PILOTPILOT ACCOUNTS

Certain Services require a PilotPilot account.

You agree to provide accurate information and maintain reasonably accurate account details.

You are responsible for:

  • safeguarding your credentials;
  • controlling access to your account;
  • securing devices connected to your account; and
  • activity occurring through your account unless caused by PilotPilot's own breach or misconduct.

You may not:

  • sell your account;
  • rent your account;
  • transfer your account without authorization;
  • share an account in a manner intended to bypass licensing restrictions;
  • impersonate another person;
  • create accounts through unauthorized automation;
  • or misrepresent your identity for fraudulent purposes.

Notify us promptly if you believe your account has been compromised.

7. PILOTPILOT CONNECTOR

PilotPilot may provide a Windows application known as the PilotPilot Connector.

The Connector may communicate with compatible flight simulation software and the PilotPilot servers.

The Connector may:

  • detect simulator availability;
  • identify aircraft;
  • receive simulator telemetry;
  • determine flight phases;
  • record flights;
  • analyze aircraft movement;
  • calculate derived flight metrics;
  • detect takeoff and landing;
  • measure simulator performance events;
  • locally buffer flight information;
  • synchronize flights;
  • authenticate your PilotPilot account;
  • and perform other functions necessary to operate PilotPilot.

Subject to these Terms, PilotPilot grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Connector for your personal use of PilotPilot.

You receive a license to use the Connector.

You do not acquire ownership of PilotPilot software.

8. SOFTWARE UPDATES

PilotPilot software may automatically check for or install updates.

Updates may be required to continue using the Services.

Updates may:

  • add functionality;
  • remove functionality;
  • repair defects;
  • modify compatibility;
  • update security systems;
  • update telemetry mappings;
  • or change technical requirements.

Older versions may cease functioning.

You authorize PilotPilot software to communicate with PilotPilot's servers as reasonably necessary to determine version status and deliver updates.

9. SIMULATOR TELEMETRY

When the Connector is active, PilotPilot may process simulator-generated information.

Depending on the aircraft and simulator, this may include information concerning:

  • simulated aircraft position;
  • latitude and longitude;
  • altitude;
  • airspeed;
  • groundspeed;
  • vertical speed;
  • heading;
  • aircraft attitude;
  • acceleration;
  • G forces;
  • engine data;
  • fuel;
  • weight;
  • configuration;
  • flight controls;
  • autopilot;
  • aircraft registration;
  • aircraft type;
  • simulation rate;
  • simulator state;
  • flight phase;
  • takeoff;
  • landing;
  • go-arounds;
  • simulator pauses;
  • simulator slew;
  • position discontinuities;
  • and related simulated-flight information.

PilotPilot may derive additional metrics from this data.

For example, PilotPilot may calculate:

  • flight distance;
  • landing performance;
  • passenger comfort;
  • taxi behavior;
  • flight phases;
  • fuel consumption;
  • harsh acceleration;
  • unusual flight events;
  • simulator-integrity events;
  • or flight scoring.

Collection and handling of information associated with an identifiable user is further described in the PilotPilot Privacy Policy.

10. LOCAL AND OFFLINE FLIGHT RECORDING

PilotPilot may temporarily store flight information on your device.

This may occur when:

  • internet connectivity is unavailable;
  • PilotPilot servers cannot be reached;
  • data is waiting to synchronize;
  • a flight is currently being recorded; or
  • recovery information is necessary to prevent loss of a flight.

Locally stored information may later be transmitted to PilotPilot when connectivity returns.

You are responsible for maintaining sufficient device storage and a reasonably functional system.

PilotPilot does not guarantee that every interrupted or corrupted flight can be recovered.

11. SIMULATOR INTEGRITY

PilotPilot may record events relevant to the integrity or interpretation of a simulated flight.

These may include:

  • slew mode;
  • simulation-rate changes;
  • teleportation;
  • abnormal position changes;
  • in-flight fuel increases;
  • aircraft changes;
  • simulator reloads;
  • replay;
  • connection interruption;
  • manipulation of telemetry;
  • modification of Connector behavior;
  • or other unusual events.

The existence of an integrity event does not necessarily mean that a user cheated or acted improperly.

PilotPilot may use integrity information to:

  • correctly interpret a flight;
  • determine eligibility for achievements or rankings;
  • investigate abuse;
  • validate career progression;
  • investigate bugs;
  • protect competitions;
  • or enforce these Terms.

12. FAIR PLAY AND FLIGHT VALIDATION

Certain PilotPilot functionality may depend upon legitimate completion of simulator flights.

You may not intentionally falsify or manipulate data submitted to PilotPilot.

Prohibited behavior includes knowingly:

  • forging telemetry;
  • modifying transmitted flight data;
  • submitting fabricated flights;
  • manipulating API requests;
  • bypassing flight validation;
  • impersonating another Connector;
  • altering PilotPilot software to falsify results;
  • exploiting bugs to obtain career benefits;
  • using unauthorized automation to generate flights;
  • or intentionally circumventing systems designed to validate flight completion.

PilotPilot may invalidate:

  • flights;
  • statistics;
  • career progress;
  • earnings;
  • achievements;
  • leaderboard results;
  • or other simulated benefits

that we reasonably determine were produced through manipulation, exploitation, or material technical error.

We may correct obvious errors without treating the user as having violated these Terms.

13. CAREER SIMULATION

PilotPilot may create a simulated professional aviation career.

Career content may include fictional:

  • companies;
  • aircraft;
  • owners;
  • passengers;
  • clients;
  • pilots;
  • dispatchers;
  • salaries;
  • benefits;
  • hiring standards;
  • employment offers;
  • schedules;
  • maintenance events;
  • training events;
  • or other scenarios.

Unless explicitly identified otherwise, these entities are fictional or simulated.

Similarities to real persons or organizations may be coincidental.

Career systems may change as PilotPilot is updated.

14. SIMULATED EMPLOYMENT

Employment through PilotPilot is fictional.

Being:

  • hired;
  • promoted;
  • disciplined;
  • paid;
  • fired;
  • assigned an aircraft;
  • given a title;
  • awarded a qualification;
  • or otherwise employed

within PilotPilot does not create any actual employment, contractor, agency, partnership, fiduciary, or other legal relationship between you and PilotPilot or any simulated operator.

Simulated salaries are not wages.

Simulated payroll is not compensation for services.

PilotPilot does not employ users merely because the career system describes them as employees.

15. VIRTUAL MONEY AND SIMULATED PAYROLL

PilotPilot may provide simulated:

  • salary;
  • payroll;
  • per diem;
  • bonuses;
  • reimbursements;
  • account balances;
  • currency;
  • credits;
  • or other economic values.

These are collectively "Virtual Value."

Unless PilotPilot expressly provides otherwise in writing:

Virtual Value has no real-world monetary value.

Virtual Value:

  • is not legal tender;
  • is not cryptocurrency;
  • is not stored value;
  • is not a bank account;
  • is not a financial product;
  • does not represent money owed to you;
  • cannot be redeemed for cash;
  • cannot be withdrawn;
  • cannot be sold;
  • cannot be transferred outside permitted PilotPilot features;
  • and does not give you a property interest in PilotPilot.

PilotPilot may adjust Virtual Value to correct technical errors, fraud, exploits, duplicate transactions, or corrupted career data.

16. CAREER TIME AND REAL TIME

PilotPilot may distinguish between:

  • real-world time;
  • simulated career time; and
  • simulator flight time.

PilotPilot may permit simulated career time to advance faster than real-world time.

For example, PilotPilot may allow a user to advance to the next simulated duty period rather than waiting several real-world days.

A career-time advancement does not necessarily accelerate:

  • subscriptions;
  • billing periods;
  • promotions tied to real time;
  • real-world cooldowns;
  • weekly simulated payroll;
  • or any other feature expressly tied to actual time.

PilotPilot determines which clock applies to each feature.

17. USER CONTENT

PilotPilot may allow users to submit or display content, including:

  • usernames;
  • profile information;
  • images;
  • messages;
  • comments;
  • custom operator content;
  • flight descriptions;
  • feedback;
  • or other material.

You retain whatever ownership rights you lawfully hold in content you submit ("User Content").

By submitting User Content, you grant PilotPilot a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, process, adapt, display, distribute, and otherwise use that User Content as reasonably necessary to:

  • operate the Services;
  • display the content as you requested;
  • moderate the Services;
  • secure the Services;
  • develop or improve features; and
  • comply with law.

This license ends when the content is deleted from our active systems, except where continued storage is reasonably necessary for backups, legal compliance, fraud prevention, dispute resolution, or other legitimate purposes.

You represent that you have the rights necessary to submit your User Content.

18. PUBLIC PROFILES AND STATISTICS

PilotPilot may offer optional public-facing features such as:

  • profiles;
  • flight histories;
  • career statistics;
  • rankings;
  • achievements;
  • operator records;
  • landing metrics;
  • or leaderboards.

Where reasonably available, privacy controls will determine what information is displayed publicly.

You should not assume that information intentionally designated public will remain private.

19. ARTIFICIAL INTELLIGENCE FEATURES

PilotPilot may offer features that use artificial intelligence or generative models.

Examples may include:

  • Chief Pilot messages;
  • dispatcher communications;
  • passenger messages;
  • career events;
  • operator interactions;
  • trip descriptions;
  • or support tools.

AI-generated content may:

  • contain errors;
  • misunderstand context;
  • repeat information;
  • generate unrealistic aviation scenarios;
  • or produce inaccurate aviation information.

AI-generated content is part of the simulation experience.

It is not professional advice and must not be relied upon for real-world aviation.

PilotPilot may identify AI-generated content where appropriate, but not every automated or procedurally generated element will necessarily be labeled individually.

20. FEEDBACK

If you submit ideas, suggestions, feature requests, concepts, bug reports, or other feedback concerning PilotPilot ("Feedback"), you grant PilotPilot the unrestricted right to use, implement, modify, commercialize, or incorporate that Feedback without payment or obligation to you.

This does not transfer ownership of unrelated intellectual property you may own.

Do not submit confidential information through Feedback unless PilotPilot has separately agreed in writing to receive it confidentially.

21. PILOTPILOT INTELLECTUAL PROPERTY

Except for User Content and third-party materials, PilotPilot and its licensors own all rights in and to the Services, including:

  • software;
  • source code;
  • object code;
  • databases;
  • interface design;
  • graphics;
  • branding;
  • logos;
  • text;
  • career systems;
  • scoring systems;
  • generated-content systems;
  • operator data structures;
  • aircraft compatibility profiles;
  • APIs;
  • documentation;
  • and other proprietary materials.

No rights are granted except those expressly provided in these Terms.

You may not use PilotPilot's name, logo, branding, or other proprietary materials in a manner that falsely implies affiliation or endorsement.

22. ACCEPTABLE USE

You agree not to:

  • use PilotPilot unlawfully;
  • interfere with the operation or security of PilotPilot;
  • attempt unauthorized access to accounts, servers, databases, APIs, or systems;
  • distribute malware through PilotPilot;
  • conduct denial-of-service attacks;
  • scrape, crawl, harvest, or systematically collect PilotPilot data except through functionality expressly provided by PilotPilot;
  • use unauthorized bots or automated systems;
  • probe or test security controls without written authorization;
  • circumvent access controls or licensing;
  • falsify telemetry;
  • exploit bugs for improper advantage;
  • harass or threaten other users;
  • impersonate another person or entity;
  • upload unlawful, infringing, defamatory, or malicious material;
  • attempt to obtain another user's credentials;
  • resell access unless PilotPilot expressly authorizes it;
  • use the Services to develop a competing product by systematically extracting proprietary PilotPilot databases, content, career data, or nonpublic APIs;
  • reverse engineer, decompile, disassemble, or attempt to derive source code except to the limited extent applicable law expressly prohibits such restriction;
  • remove copyright, trademark, or proprietary notices;
  • bypass technical protections; or
  • use PilotPilot in a manner reasonably likely to damage the Services or other users.

23. API ACCESS

PilotPilot may provide APIs.

API access may require separate credentials, documentation, or terms.

Unless expressly authorized, you may not:

  • expose private API keys;
  • circumvent rate limits;
  • access undocumented private APIs;
  • reproduce substantial portions of PilotPilot databases;
  • use an API to bypass paid functionality;
  • or offer unauthorized third-party access to PilotPilot.

We may modify or discontinue APIs.

24. BETA AND EXPERIMENTAL FEATURES

PilotPilot may offer:

  • alpha software;
  • beta software;
  • early-access software;
  • experimental features;
  • test environments;
  • preview aircraft support;
  • or unfinished functionality.

Such features may:

  • contain bugs;
  • lose data;
  • change substantially;
  • become unavailable;
  • or never reach general release.

Use beta or experimental functionality at your own risk.

PilotPilot may reset beta data.

If a paid product is sold specifically as Early Access, the checkout page may contain additional disclosures regarding its development state.

25. PURCHASES

Some PilotPilot Services may require payment.

Prices and material purchase terms will be disclosed before you complete a transaction.

You authorize PilotPilot and its payment processors to charge the payment method you provide for the amounts shown at checkout.

You are responsible for applicable taxes unless PilotPilot is legally required to collect and remit them.

PilotPilot may use third-party payment processors.

PilotPilot generally does not need to receive or store your complete payment-card number where payment processing is handled by such providers.

26. SUBSCRIPTIONS AND AUTOMATIC RENEWAL

PilotPilot may offer recurring subscriptions.

WHEN YOU PURCHASE A RECURRING SUBSCRIPTION, YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE INTERVAL AND PRICE DISCLOSED AT CHECKOUT UNTIL YOU CANCEL, UNLESS OTHERWISE REQUIRED BY LAW.

Before purchase, PilotPilot will disclose material subscription terms, including:

  • price;
  • billing interval;
  • whether the subscription renews automatically;
  • and how to cancel.

You authorize PilotPilot or its payment processor to charge the applicable recurring subscription fee until cancellation.

You may cancel an online subscription through your PilotPilot account using an online cancellation method that is at least as accessible as the method used to subscribe.

Where required by applicable law, PilotPilot will provide renewal notices or additional disclosures.

Cancellation prevents future renewals.

Unless otherwise required by law or stated at checkout, cancellation does not retroactively refund amounts already charged and access continues through the end of the paid billing period.

27. FREE TRIALS AND PROMOTIONS

PilotPilot may offer free trials, introductory pricing, or promotional offers.

Additional terms may apply.

Where a free trial automatically converts into a paid subscription:

  • the conversion terms;
  • price;
  • billing interval;
  • and cancellation method

will be disclosed before enrollment.

You are responsible for canceling before the stated conversion date if you do not wish to continue the paid service.

PilotPilot may limit eligibility for repeated trials or promotions.

28. PRICE CHANGES

PilotPilot may change prices.

A price change will not alter an already completed one-time purchase.

For recurring subscriptions, we will provide advance notice of material price changes where required by law.

If you do not wish to pay a new recurring price, you may cancel before the new price becomes effective.

29. LIFETIME ACCESS

PilotPilot may offer products described as:

  • "Lifetime";
  • "Lifetime Access";
  • "Lifetime License";
  • or similar language.

Unless expressly stated otherwise at purchase, "Lifetime" refers to the commercial lifetime of the applicable PilotPilot product or service, not the biological lifetime of the purchaser.

A Lifetime purchase provides the purchaser a non-transferable right to access the applicable purchased functionality while PilotPilot continues to make that product or functionality commercially available.

A Lifetime purchase:

  • is not ownership of PilotPilot;
  • does not guarantee that PilotPilot will operate forever;
  • does not guarantee that any particular server, third-party integration, aircraft compatibility profile, API, feature, or simulator platform will exist forever;
  • does not include unrelated future products unless expressly stated;
  • does not include optional separately sold services unless expressly stated;
  • and does not exempt the user from these Terms.

PilotPilot may modify features over time.

If PilotPilot permanently discontinues the entire applicable Lifetime product, we may provide reasonable advance notice where commercially practicable.

Nothing in this section limits rights you may have under mandatory consumer-protection law.

30. REFUNDS

Except where:

  • required by applicable law;
  • expressly stated at checkout;
  • provided by a separately published PilotPilot Refund Policy; or
  • voluntarily approved by PilotPilot,

fees paid for digital Services are non-refundable.

If PilotPilot publishes a Refund Policy, that policy is incorporated into these Terms.

Nothing in these Terms limits mandatory refund, withdrawal, cancellation, or consumer rights that cannot legally be waived.

31. PAYMENT DISPUTES AND CHARGEBACKS

You retain any lawful right to dispute an unauthorized or improper charge.

Before initiating a chargeback for a billing issue, we encourage you to contact PilotPilot so we can attempt to resolve the issue.

Knowingly submitting a false or fraudulent chargeback may result in account restriction or termination.

PilotPilot may provide payment processors with records reasonably necessary to respond to a payment dispute.

32. FRAUD

PilotPilot may refuse, cancel, or reverse a transaction where we reasonably believe:

  • payment information was stolen;
  • a transaction is fraudulent;
  • account takeover occurred;
  • the transaction violates law;
  • or the transaction was created through abuse of a promotion or payment system.

Where appropriate, funds will be handled according to applicable law and payment-processor requirements.

33. SERVICE AVAILABILITY

PilotPilot strives to provide reliable Services but does not guarantee uninterrupted operation.

PilotPilot may experience:

  • maintenance;
  • server outages;
  • software defects;
  • database errors;
  • network failures;
  • denial-of-service attacks;
  • third-party outages;
  • simulator updates;
  • Microsoft Flight Simulator changes;
  • SimConnect changes;
  • cloud-provider outages;
  • payment-provider outages;
  • or events beyond PilotPilot's reasonable control.

PilotPilot may temporarily suspend functionality for maintenance, security, or operational reasons.

34. CHANGES TO PILOTPILOT

PilotPilot is an evolving software service.

We may add, modify, rebalance, replace, or remove functionality.

This may include:

  • career systems;
  • scoring;
  • operators;
  • aircraft compatibility;
  • simulated salaries;
  • payroll rules;
  • career progression;
  • user interfaces;
  • telemetry systems;
  • AI systems;
  • APIs;
  • statistics;
  • or integrations.

No particular game balance, operator, aircraft, feature, scoring method, or career mechanic is guaranteed to remain unchanged indefinitely.

35. THIRD-PARTY SERVICES

PilotPilot may contain links to or integrate with third-party services.

Examples may include:

  • flight simulators;
  • payment processors;
  • authentication providers;
  • mapping providers;
  • weather providers;
  • navigation-data services;
  • analytics systems;
  • AI providers;
  • cloud services;
  • or community platforms.

Third-party services are governed by their own terms and privacy practices.

PilotPilot does not control those services.

36. TERMINATION BY YOU

You may stop using PilotPilot at any time.

You may request account deletion through available account controls or by contacting PilotPilot.

Canceling a subscription and deleting an account are different actions.

Deleting an account does not automatically entitle you to a refund.

Some records may remain after deletion where necessary for:

  • legal compliance;
  • financial recordkeeping;
  • fraud prevention;
  • security;
  • backups;

subject to applicable privacy law.

37. SUSPENSION OR TERMINATION BY PILOTPILOT

PilotPilot may suspend or terminate access where reasonably necessary because of:

  • material violation of these Terms;
  • fraud;
  • unlawful conduct;
  • security threats;
  • payment fraud;
  • abuse of other users;
  • deliberate telemetry falsification;
  • unauthorized system access;
  • repeated material exploitation of bugs;
  • sanctions restrictions;
  • or other serious misuse of the Services.

Where reasonable, we may provide notice or an opportunity to cure.

Immediate action may be taken where necessary to protect PilotPilot, users, third parties, or the security of the Services.

Termination for material breach may result in loss of access to purchased Services to the extent permitted by law.

38. EFFECT OF TERMINATION

When these Terms or your account terminate:

  • your license to access the Services ends;
  • your right to use the Connector may end;
  • certain online data may become inaccessible;
  • outstanding amounts remain due;
  • and provisions that by their nature should survive termination will survive.

Surviving provisions include, as applicable:

  • intellectual property;
  • disclaimers;
  • limitations of liability;
  • indemnification;
  • dispute resolution;
  • governing law;
  • and miscellaneous contractual provisions.

39. COPYRIGHT COMPLAINTS

PilotPilot respects intellectual-property rights.

If you believe content available through PilotPilot infringes your copyright, send a notice containing sufficient information to identify:

  • the copyrighted work;
  • the allegedly infringing material;
  • your contact information;
  • your good-faith basis for the complaint;
  • and any other information required by applicable law

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

PILOTPILOT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF:

  • MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;
  • TITLE;
  • NON-INFRINGEMENT;
  • ACCURACY;
  • AVAILABILITY;
  • QUIET ENJOYMENT;
  • AND FITNESS FOR REAL-WORLD AVIATION USE.

PilotPilot does not warrant that:

  • the Services will always function;
  • flight data will always be accurate;
  • every aircraft will be compatible;
  • every recorded flight will synchronize;
  • every third-party integration will continue operating;
  • career data will never need correction;
  • software will be error-free;
  • AI content will be accurate;
  • or PilotPilot will satisfy a particular user's expectations.

Some jurisdictions do not allow certain warranty exclusions.

In those jurisdictions, exclusions apply only to the extent permitted by law.

41. NO SAFETY WARRANTY

Without limiting the previous section:

PilotPilot does not warrant the accuracy or suitability of information concerning:

  • weather;
  • navigation;
  • aircraft systems;
  • aircraft performance;
  • flight planning;
  • fuel;
  • airports;
  • runway suitability;
  • terrain;
  • maintenance;
  • regulations;
  • or flight operations.

Never use PilotPilot as a substitute for approved real-world aviation information.

42. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PILOTPILOT AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITY, OR USE, ARISING OUT OF OR RELATING TO THE SERVICES.

To the maximum extent permitted by law, PilotPilot's aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of:

  • the amount you paid to PilotPilot during the twelve months immediately preceding the event giving rise to the claim; or
  • US $100.

These limitations apply regardless of:

  • the legal theory asserted;
  • whether damages were foreseeable;
  • and whether PilotPilot was advised of the possibility of damages.

These limitations do not apply where prohibited by law.

They do not exclude liability that cannot lawfully be limited, such as liability that applicable law requires to remain available.

43. INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold harmless PilotPilot and its affiliates, officers, directors, employees, and agents from third-party claims, liabilities, damages, losses, and reasonable costs arising from:

  • your unlawful use of the Services;
  • your material violation of these Terms;
  • your User Content;
  • your infringement of another person's rights;
  • or your intentional misuse of PilotPilot.

This section does not require you to indemnify PilotPilot for PilotPilot's own unlawful conduct.

PilotPilot may control the defense of an indemnified claim, and you agree to reasonably cooperate.

44. INFORMAL DISPUTE RESOLUTION

Before initiating arbitration or a lawsuit, you and PilotPilot agree to attempt in good faith to resolve the dispute informally.

The complaining party must send a written Notice of Dispute.

Notices to PilotPilot must be sent to:

The notice should include:

  • the account holder's name;
  • account email;
  • a description of the dispute;
  • the specific relief requested;
  • and reasonably relevant supporting information.

The parties will have 30 days after receipt of a complete Notice of Dispute to attempt resolution.

Either party may begin arbitration after that period if the dispute remains unresolved.

Applicable limitation periods are tolled during this 30-day period to the extent permitted by law.

45. BINDING ARBITRATION AGREEMENT

PLEASE READ THIS SECTION CAREFULLY.

If you reside in the United States, you and PilotPilot agree that, except as expressly stated below, any dispute, claim, or controversy arising out of or relating to:

  • these Terms;
  • PilotPilot;
  • your account;
  • a purchase;
  • a subscription;
  • the Connector;
  • flight data;
  • or the relationship between you and PilotPilot

will be resolved through individual binding arbitration rather than in court.

This arbitration agreement is governed by the Federal Arbitration Act ("FAA"), 9 U.S.C. §§ 1 et seq.

Arbitration will be administered by the American Arbitration Association ("AAA") under its applicable Consumer Arbitration Rules, as modified by these Terms.

If AAA is unavailable or unwilling to administer the dispute, the parties will attempt to agree upon another nationally recognized arbitration provider.

If they cannot agree, a court of competent jurisdiction may appoint an arbitrator or provider as permitted by law.

The arbitrator may award the same individual remedies that a court could award, subject to lawful limitations contained in these Terms.

The arbitrator will have authority to determine issues concerning the interpretation and application of this arbitration agreement, except that a court will determine disputes concerning the enforceability of the class-action waiver where applicable.

Arbitration may occur by:

  • documents;
  • telephone;
  • videoconference;
  • or in-person hearing

as permitted by the applicable rules.

PilotPilot will pay arbitration fees to the extent required by applicable consumer arbitration rules or law.

46. ARBITRATION EXCEPTIONS

Either party may bring an eligible individual claim in small-claims court.

Nothing in this arbitration agreement prevents either party from seeking temporary or preliminary injunctive relief from a court where such relief is necessary to prevent imminent unauthorized access, intellectual-property infringement, or security abuse pending arbitration.

Nothing in these Terms requires arbitration of a claim that applicable law makes non-arbitrable.

Where applicable law provides a non-waivable right to seek public injunctive relief in court, that claim may proceed in court after arbitrable individual claims have been resolved to the extent legally required.

47. CLASS ACTION WAIVER

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND PILOTPILOT AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS.

Neither party will:

  • bring a claim as a plaintiff or class member in a class action;
  • seek class-wide arbitration;
  • participate in a representative action;
  • combine claims of separate individuals without consent;
  • or seek relief on behalf of persons other than the individual claimant,

except where applicable law prohibits this waiver.

An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim.

48. JURY TRIAL WAIVER

WHERE PERMITTED BY LAW, YOU AND PILOTPILOT KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A TRIAL BY JURY FOR DISPUTES COVERED BY THESE TERMS.

49. ARBITRATION OPT-OUT

You may opt out of Sections 45 through 48 by sending a written opt-out notice within 30 days after the date you first accept these Terms.

The notice must include:

  • your full name;
  • your PilotPilot account email;
  • and an unambiguous statement that you wish to opt out of PilotPilot's arbitration agreement.

Opting out of arbitration will not affect your ability to use PilotPilot.

An opt-out applies only to the account holder who timely submitted it.

If you validly opt out, disputes will be governed by the court provisions below.

50. GOVERNING LAW

Except where federal law governs or mandatory local law provides otherwise, these Terms and disputes arising out of them are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

The FAA governs the interpretation and enforcement of the arbitration provisions for U.S. users.

Nothing in this section deprives a consumer of mandatory protections that cannot lawfully be waived in the consumer's jurisdiction.

51. COURT VENUE

For disputes not required to be arbitrated, and except where applicable law requires another forum, you and PilotPilot consent to exclusive jurisdiction and venue in the state courts located in Bay County, Florida, or the applicable United States federal court having jurisdiction over Bay County, Florida.

This section does not prevent an eligible party from using small-claims court where permitted.

52. USERS OUTSIDE THE UNITED STATES

If you reside outside the United States, mandatory consumer laws in your country or region may provide rights that these Terms cannot waive.

Nothing in these Terms is intended to eliminate those mandatory rights.

The arbitration and venue provisions apply only to the extent enforceable where you reside.

PilotPilot may restrict availability in certain jurisdictions.

53. EXPORT CONTROLS AND SANCTIONS

You may not use, export, re-export, transfer, or provide PilotPilot in violation of applicable U.S. export-control or sanctions laws.

You represent that your use of the Services is not prohibited by applicable sanctions restrictions.

54. FORCE MAJEURE

PilotPilot is not responsible for delay or failure caused by circumstances beyond its reasonable control.

Examples include:

  • natural disasters;
  • war;
  • terrorism;
  • civil unrest;
  • governmental action;
  • internet outages;
  • widespread cloud failures;
  • labor disruptions;
  • power failures;
  • cyberattacks;
  • failures of third-party platforms;
  • changes to Microsoft Flight Simulator;
  • changes to SimConnect or simulator APIs;
  • or similar events.

This section does not limit rights that applicable law does not permit us to limit.

55. CHANGES TO THESE TERMS

PilotPilot may update these Terms.

If changes are material, we will provide reasonable notice, such as through:

  • the website;
  • the application;
  • account notification;
  • or email.

The updated Terms will state a new effective date.

Where required by law, we will obtain renewed consent.

Otherwise, continued use of PilotPilot after the effective date of updated Terms constitutes acceptance of the updated Terms.

Changes will not retroactively alter a dispute that arose before the updated Terms became effective where doing so would be unlawful.

56. ELECTRONIC COMMUNICATIONS

You agree that PilotPilot may provide contractual notices electronically.

Electronic notices may be provided through:

  • email;
  • account notifications;
  • the PilotPilot website;
  • or the PilotPilot application.

You are responsible for maintaining a valid email address associated with your account.

Marketing communications are governed separately by applicable law and any available communication preferences.

57. ASSIGNMENT

You may not assign or transfer these Terms or your account without PilotPilot's written consent.

PilotPilot may assign these Terms in connection with:

  • a merger;
  • acquisition;
  • corporate restructuring;
  • sale of assets;
  • financing;
  • or transfer of the PilotPilot business,

subject to applicable law.

58. NO THIRD-PARTY BENEFICIARIES

Except where expressly stated, these Terms do not create enforceable rights for third parties.

59. NO WAIVER

Failure by PilotPilot to enforce a provision of these Terms does not waive our right to enforce it later.

A waiver must be clear and, where appropriate, in writing.

60. SEVERABILITY

If a provision of these Terms is held invalid or unenforceable, the provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

If a provision cannot lawfully be narrowed or modified, it will be severed only to the minimum extent necessary.

Special severability rules in the arbitration section will be applied consistently with applicable law.

61. HEADINGS

Section headings are provided for convenience and do not limit the meaning of these Terms.

62. ENTIRE AGREEMENT

These Terms, together with policies and purchase terms expressly incorporated by reference, constitute the agreement between you and PilotPilot concerning the Services.

Relevant incorporated documents may include:

  • PilotPilot Privacy Policy;
  • PilotPilot Refund Policy;
  • specific subscription terms;
  • promotional terms;
  • contest rules;
  • beta agreements;
  • or additional terms displayed before use of a particular feature.

If specific written terms for a product directly conflict with these general Terms, the more specific terms govern with respect to that product.

BY CREATING AN ACCOUNT, PURCHASING PILOTPILOT, DOWNLOADING OR USING THE PILOTPILOT CONNECTOR, OR OTHERWISE ACCESSING THE SERVICES AFTER BEING PRESENTED WITH THESE TERMS, YOU ACKNOWLEDGE THAT:

  • YOU HAVE READ THESE TERMS;
  • YOU UNDERSTAND THAT PILOTPILOT IS A FLIGHT-SIMULATION PRODUCT;
  • YOU UNDERSTAND THAT PILOTPILOT IS NOT FOR REAL-WORLD AVIATION;
  • YOU AGREE TO THE APPLICABLE PURCHASE AND SUBSCRIPTION TERMS;
  • YOU UNDERSTAND THAT SIMULATOR TELEMETRY MAY BE PROCESSED;
  • AND YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS.
